Do you remember a few short weeks ago on December 19th when the partisan Colorado Supreme Court chose to remove President Trump, by a 4-3 decision, from the state’s presidential primary ballot? I certainly remember, and I firmly believe that there is no truer threat to our Republic, and no greater threat to due process, than the targeting of political opponents to deny them ballot access. Think about what this means for election integrity as well. The voters decide elections – not partisan, unelected bureaucrats who are hellbent on subverting the will of the American people.

There’s important news that you should know about. I’ve joined my Republican colleagues in both the People’s House, and the U.S. Senate, in filing an amicus brief in the case of Donald J. Trump v. Norma Anderson, et al. that’s before the Supreme Court. The purpose of this amicus brief is to support President Trump’s ballot appeal in Colorado, and it establishes several arguments as to why the Colorado Supreme Court’s decision is not only wrongheaded, but also an attempt to undercut the authorities that are explicitly vested in Congress. Here are a few of the arguments that we have made:

  • The Colorado Supreme Court’s decision infringes on Congress’s express powers.
  • The Colorado Supreme Court’s decision lacks neutral principles and will lead to widespread de-balloting of political opponents.
  • A lengthy list of partisan grievances could be labeled as “engaging in insurrection”.

Imagine the sheer ruin that would engulf our nation if rotten precedent – like what the Colorado Supreme Court intends to set – is allowed to become reality. Our system of elections would be subject to rampant abuse and the voice of the people would be drowned out entirely. I’m proud to have joined my Republican colleagues in filing this amicus brief, and I’m equally as proud to stand up for election integrity against all manner of threats so that the American people can cast their ballots with confidence.

Mayorkas Impeachment Update

Next Tuesday, the House Committee on Homeland Security is marking up the articles of impeachment against Homeland Security Secretary Alejandro Mayorkas. By following regular order, as I have advocated for previously, the committee had the opportunity to conclude its ongoing investigation into Secretary Mayorkas and move at an expedited pace in its consideration of these articles. It’s well known that I voted to refer the impeachment process to the House Committee on Homeland Security. What’s coming to light now is that this vote expedited the process by giving that committee sole jurisdiction over the articles, giving us the quickest possible timeline to actually move these articles of impeachment to the Senate where a conviction can and should be affirmed. Furthermore, following regular order has also preserved precious taxpayer dollars that would have otherwise been wasted if the committee’s investigation had been immediately cut short.

Once the articles of impeachment are brought to the House floor for a full vote, you can expect me to immediately vote in favor of them – Secretary Mayorkas has failed to protect our nation, and the facts confirm this.

Another Failed Audit

The Department of Education has failed its annual audit for the second consecutive year, and as a result, hardworking taxpayers in our country have been failed again. I’ve just led a letter with Representative Lloyd Smucker to Secretary of Education Miguel Cardona directing him to appear before the Education and Workforce Committee to answer for the Department’s failures under his leadership. Here's a short excerpt:

“Secretary Cardona, it is imperative that you understand and take responsibility for the Department’s failures. The Department’s bungling, dereliction of duties, and general disregard for the interests of the taxpayer are an embarrassment. The Nation deserves better.”
